LAST WILL AND TESTAMENT OF A.L. PACE
KNOW ALL MEN BY THESE PRESENTS:
That I, A.L. Pace, being of sound mind but having suffered an injury which is giving me some uneasiness as to my physical state of health, and desiring to make certain distribution of my property in case of my death, I do make, publish and declare this to be my Last Will and Testament. FIRST
I will and direct that if I should owe any debts at the time of my death, the same shall be paid out of my estate.
SECOND
I give, devise and bequeath to my beloved wife, DORA PACE, all of my property, whether real estate, personal property or mixed, and wheresoever situate, absolutely and in fee simple, without any limitations whatever. For the information of anyone interested, I declare I have no children and no descendant’s and have never have had any. Signed by me and published and declared to be my Last Will and Testament in the presence of Miss Lucille Marquess and A.L. Smith at Siloam Springs, Arkansas, this 9th day of May, 1927, which at my request will witness this will. A.L. Pace Signed by the said A. L. Pace and by him published and declared to be his Last Will and Testament in our presence, who in his presence and at his request and in the presence of each other have subscribed our names as witnesses hereto. PROOF OF WILL
STATE OF ARKANSAS} COUNTY OF BENTON} SS. Personally appeared before me Anna Patton, Clerk of the County and Probate Court, of Benton County, Arkansas, Lucille Marquess and A. L. Smith to me well known, who being duly sworn say: That they are the subscribing witnesses to the foregoing instrument of writing, purporting to be the last will and testament of A. L. Pace deceased, who died in Benton County, Arkansas on or about 3rd day of December 1928; that said instrument was executed at the time, place and by the person therein named; that said A. L. Pace the Testator was at the time of signing said instrument upwards of twenty-one years of age and of sound and disposing mind and memory, and that in the presence of both of these affiants he declared it to be his last will and Testament and subscribed his name thereto wrote in the presence of both these affiants; that at the request of said Testator affiants wrote their names to his said will in his presence and in the presence of each other; that the subscribers to the foregoing instrument of writing are genuine, and that said instrument which is hereto attached is the identical one that affiants so witnessed and saw the said A.
